03. 2012 EDITORIAL Sehr geehrte Damen und Herren, liebe Freundinnen und Freunde der Friedrich-Ebert-Stiftung, unser Partner HDIP hat in einem gemeinsamen Projekt, das durch das Deutsche Vertretungsbüro in den Palästinensischen Gebieten unterstützt wurde, die Lokalwahlen im Oktober diesen Jahres beobachtet. Die Wahlen, die seit 2010 mehrfach verschoben worden waren, fanden vor dem Hintergrund der andauernden politischen Spaltung lediglich in der Westbank und nicht in Gaza statt. Zudem wurden sie von Hamas boykottiert. Die unabhängigen zivilgesellschaftlichen Beobachter, die in allen Regionen der Westbank im Einsatz waren, kommen zu dem Ergebnis, dass die Lokalwahlen insgesamt frei und fair abgelaufen sind. Ursprünglich sollten die Lokalwahlen in zwei Runden stattfinden: Am 20. Oktober 2012 wurde in den größeren Städten und Gemeinden der Westbank gewählt, Ende November 2012 sollte in einem zweiten Wahlgang in all jenen Bezirken gewählt werden, in denen sich zum ersten Stichtag keine Kandidaten-Liste hatte zur Wahl stellen lassen. Nachdem der zweite Urnengang jedoch abgesagt wurde, senden wir Ihnen mit dem heutigen Newsletter den Bericht der HDIP Wahlbeobachter, der am 1. Dezember 2012 in Ramallah der Presse vorgestellt wurde. Der Bericht geht auf einige Fälle ein, in denen Verstöße gegen die Regularien durch Kandidaten, Sicherheitskräfte und Angestellte der Wahlkommission, die mit der Leitung der Wahllokale beauftragt waren, stattgefunden haben und richtet Empfehlungen an die Wahlkommission für die künftige Durchführung von Wahlen, um Missbrauch und Verstösse zu verhindern. the readiness of the voting locations to be accessible for the persons with special needs. It was noticed that some ballot stations were located in upper floors, which makes it difficult for such people to cast their votes. Third: Election campaigns ] As above-mentioned, it was clearly observed that manifestations of the election campaigns continued on the ballot day in the different ballot centers and stations, which is a flagrant violation to the provisions of the Law. The supporters of lists were seen distributing lists and hanging posters inside the ballot centers and their surroundings. Also, many persons entered the ballot centers, which created a state of chaos in some centers and hindered the voters from practicing right in choosing freely the list they want. Consequently, HDIP believes that the control officer should stand at the door of the center instead of standing at the station door so as to ensure that only the voters enter the center. Similarly, the police men should organize the voters’ queues inside the center and evacuate the center from those who have already cast their votes. Fourth: Employees of the Central Elections Commission The HDIP observers documented violations committed by the ballot centers directors in a number of centers. These violations are represented in applauding a specific list and allowing the supporters of that list to influence the voters. Moreover, they were not neutral in dealing with the agents of certain lists and refused to receive their complaints. Therefore, the Central Elections Commission should reconsider the mechanism of appointing the officers of the ballot day. HDIP also recommends that appointing the officers should be through the Commission and not through the Ministry of Education. Other remarks included the arbitrary appointing of officers and moving the directors of the ballot centers arbitrarily to centers other than the local councils they belong to. 27 0 "٢٠١٢ ﺔﻴﻠﶈﺍ ﺕﺎﺑﺎﺨﺘﻧﻻﺍ ﻰﻠﻋ ﺔﺑﺎﻗﺮﻟﺍ ﺮﻳﺮﻘﺗ"

HDIP believes that the work of Central Elections Commission revealed some shortcomings regarding the elections campaigns progress, which may have resulted from absence of mechanisms and controls that ensure commitment to the provisions of campaigning by the lists. As regards the ballot day, HDIP emphasizes that the elections were organized and the voting and counting of votes processes were impartial and fair in all the ballot stations although certain violations were committed by the directors of ballot stations appointed by the Ministry of Education. Nevertheless, HDIP observers have documented a number of remarks that did not affect the fairness of the elections results. To avoid such violations, HDIP hopes that the Central Elections Commission takes the following remarks into consideration: First: Regarding the illiterates The exception given to the illiterate and disabled voters, which allows them to be accompanied by attendants was remarkably manipulated and exploited. Although the Elections Procedures Manual stresses that the attendant should be a second degree relative, HDIP believes in the necessity of reconsidering the adopted procedures regarding voting of the illiterate and disabled whose disabilities prevent them from voting personally. This requires new procedures that enable them to practice their right according to the law and at the same time prevent misusing the exception for the unfair purposes of the attendant, which harm the election process. In the same context, it is important to create a mechanism that puts an end to allegations of illiteracy, which allows for buying votes and influences the illiterate voters’ choices. Second: Regarding the disabled The voter’s access to the ballot station is a right for every citizen, especially persons with special needs, to facilitate his/her participation in the elections. The Central Elections Commission should take into consideration "٢٠١٢ ﺔﻴﻠﶈﺍ ﺕﺎﺑﺎﺨﺘﻧﻻﺍ ﻰﻠﻋ ﺔﺑﺎﻗﺮﻟﺍ ﺮﻳﺮﻘﺗ" 2189

The HDIP observers documented some violations in two election centers in Hebron. These two violations were done by the two centers’ directors when they asked the observers and agents to leave their stations for 15 minutes for a break. In this concern, the Local Councils Elections Balloting and Voting Manual stated that the station director shall be given a break for a period not more than 10 minutes without leaving the station empty of the CEC team, observers and agents. Getting out of the station is allowed for those who are willing to do that. Counting and Sorting Processes The HDIP observers mentioned that the counting process in most of the balloting stations went smoothly without significant problems that may affect the fairness of the elections process. They also mentioned that ballot committees’ members abided by the Law regarding the counting process. They started by preparing a counting report of the required preliminary data, which included the number of registered voters, number of ballot papers, number of unused ballot papers, number of voters who cast their votes, number of voters who did not cast their votes and number of invalid ballot papers. HDIP observers did not document any remarks concerning the mechanism of the counting process. Completion of the Counting and Sorting Processes The counting and sorting of votes and identification of the number of votes that each list got went on smoothly and no significant violations were mentioned. The used ballot papers were packed in special envelops (envelope of blank papers, envelope of void papers, envelope of valid papers, and envelope of unused papers). All procedures have been completed with full transparency in the sight of the authorized observers and lists agents. Summary and Recommendations HDIP is confident of the integrity of the election process. Nevertheless, it has certain remarks on violations made regarding the elections campaigns 2198 "٢٠١٢ ﺔﻴﻠﶈﺍ ﺕﺎﺑﺎﺨﺘﻧﻻﺍ ﻰﻠﻋ ﺔﺑﺎﻗﺮﻟﺍ ﺮﻳﺮﻘﺗ"

CEC directors in certain balloting centers by applauding a specific list and facilitating the work of this list’s agents and supporters. Another case was documented for a female CEC director of a balloting center who helped a specific list using the rotating paper in the voting. • Misuse of exception granted to the illiterates and the physically disabled to be accompanied by attendants. According to the Local Councils Elections Balloting and Voting Manual issued by the Central Elections Committee, the illiterate or the disabled voter have the right to be accompanied by an attendant whom he/she chooses from his relatives of first and second degree to assist him/her in the voting process. But the Manual has not identified the number of voters allowed to be accompanied to cast their votes. HDIP observers documented several violations where the stations directors did not verify the degree of relativity between the voter and his/her attendant. In this context, many cases were documented in which a voter was accompanied by a non-relative person. Moreover, certain balloting stations were located in upper floors, the fact which prevented certain persons with special needs from accessing the ballot stations and boxes. • Regarding end of balloting According to the Local Councils Elections Law No.10 of 2010, the ballot boxes shall close at 7 in the evening. As soon as the ballot process was over, the majority of the ballot stations closed. Then the head of each station announced the end of balloting and the doors of stations closed. Following that, the head of each ballot station closes the ballot box with plastic locks and this process should be in the sight of observers and electoral lists agents. Third: Interference and non-neutrality of the security apparatuses HDIP observers documented flagrant interference of the security apparatuses in certain locations. This interference was represented in using the government cars for transporting the voters. Another violation of the security forces was represented in interfering with the voters to find their names in the elections register and directing them to the ballot stations. The interference of the security forces blatantly manifested on the advance balloting day allocated for the security forces by bringing the security members to the balloting centers, checking the elections register and putting a sign on the members who voted and those who didn’t and sought to bring them to vote for a specific list. Fourth: Performance of the Central Elections Commission Since the beginning of the elections process, the Central Elections Commission worked with transparency, fairness and impartiality whether in the registration of voters, list or regarding the elections campaign. Moreover, certain electoral lists stuck their campaigning materials on the balloting day on the walls, at the entrance and inside the balloting center. It was noticed that the Central Elections Commission did not take a clear mechanism to force the electoral lists to remove their posters and other campaigning materials. Second: Attempts to influence voters’ choices The HDIP observers documented a number of violations that may have influence on voters’ choices. And more than this, some voters were intimidated by an electoral list supporters. Intimidation included taking the voters’ ID cards before entering the balloting centers in pretext of verifying their names. The observers also received complaints related to the interference of the security apparatuses elements in citizens. Also the police men interfered in forcing the agents of certain lists to get out from the ballot center. Furthermore, a rotating paper was used in certain ballot centers, which proves that pressure and intimidation were used during the elections process in addition it is said that some votes were bought by certain lists, which is considered legal violation and criminal offense. manner serving specific lists. A voter said that he is registered in Qabatia and he previously voted in it but when he went to vote, he found that his name was not listed. But he found his name in Jenin voters’ lists. • A security man entered with his weapon to the balloting center in Jenin. • The electoral register was not available outside the balloting center allocated for the security forces in Tulkarem. Balloting and Counting Day In the early morning on Saturday 20 October 2012, the Central Elections Commission teams were distributed in the 93 locations throughout the West Bank in which the election process will be held. These teams were accompanied by the agents of electoral lists, local observers from the civil society organizations, including the HDIP observers, who participated in the observation process starting with opening of the ballot boxes at 7 a.m. until closure of ballot boxes at 7 p.m. HDIP observers in the different locations followed up the details of the balloting process and the legal violations committed by certain lists and they documented the following: First: Campaigning materials are not removed from the balloting centers According to the Central Elections Commission and pursuant to Article 27 of the Local Councils Elections Law No.12 of 2005, the last day for the elections campaign was mid night of 18 October 2012. Consequently, all lists were supposed to remove their campaigning materials especially from places located nearby the balloting centers. But this did not happen and the campaigning materials of certain lists remained as if the elections campaign period has not ended. 3134 "٢٠١٢ ﺔﻴﻠﶈﺍ ﺕﺎﺑﺎﺨﺘﻧﻻﺍ ﻰﻠﻋ ﺔﺑﺎﻗﺮﻟﺍ ﺮﻳﺮﻘﺗ"

Security Apparatuses Advance Voting The security forces voted on 18 October 2012. According to the Executive Director of the Central Elections Commission Hisham Kheil, 40% of the security forces were supposed to participate in the voting. The voting process took place in a quiet environment without any unusual manifestations or problems or competitiveness among electoral lists. The voters were pre-determined to vote for one party and all the other lists were aware of this fact and they believed that any campaigning will be useless on the balloting day although that campaigning is still valid until mid night of 18 October. Despite the absence of the competitive spirit, the HDIP local observers registered certain violations. Pursuant to the Elections Law, particularly the provision on the balloting process, the observers documented the following violations: • The organized way in which the security apparatuses brought the voters to the balloting centers looked as if they are a political party mobilizing votes for a specific party. • Threats of dismissal for security apparatuses members if they do not vote for the Independence and Development list. • Some security members pretended that they are illiterate. One case was documented in Al-Karama Basic School in Jenin where a person claiming that he is illiterate voted through an attendant, who is not his relative. This happened although the balloting station director discovered that before casting the vote. • Using the security cars to transport the voters. This violation was documented in most of the balloting centers. The security men were also transported in the company of their seniors and were seen entering the balloting centers in queues after giving military salute for their senior officers. • Distributing the electoral register of the security forces in a 13

to the Central Elections Commission, which did not take any action in that regard, and this made the list’s representative withdraw his list, in fear of the security apparatuses threats. Second: Challenges to the Commission’s decisions regarding rejection of lists 15 challenges have been submitted regarding the Commission’s rejection of lists. The court rejected 10 challenges and accepted two. The court’s decision required removing the candidate who has not fulfilled the nomination conditions in order to accept the list. Al-Bireh for All is one of these lists, which was rejected because one of its candidates was registered in another constituency. In this case the court asked for removal of that candidate. But by removing that candidate the list became incomplete. As a result, the Central Elections Commission rejected the list. Third: Non-compliance with the elections campaign period Inspite of the prohibition and restrictions imposed by the law, some violations have been documented by the HDIP observers. These violations included commencing the elections campaign before the designated period and continuing it after that period by certain electoral lists. Other lists put posters in the vicinity of the polling centers and keeping it there until 20 October 2012, which is the balloting day. It is worth noting that manifestations of elections campaigns of certain lists continued until the balloting day. It was also familiar to see on the ballot day supporters of a list distributing campaign materials and trying to influence the voters and convincing them to vote for the list they support. Not only this, some candidates were seen distributing election campaign materials in front of mosques and churches in different locations. 12

Balloting and Counting Balloting and counting day is one of the most important elements of the elections process. It is the crucial day on which the elections are classified as impartial and transparent or as false. It is also the day on which voters go to the ballot centers to cast their votes under the supervision and administration of the Central Elections Commission’s employees. It is also the day on which the electoral lists and their supporters and volunteers actively work to bring votes for their lists. Finally, this is the day on which legal infringements and violations of the applicable law occur and on this day the HDIP observers played an important role in observing the elections progress. Legal Violations of the Elections Process First: Registration of lists The process for registering the elections lists by the Central Elections Commission has been implemented smoothly, easily and with full transparency, which guaranteed validity of registration. The Commission said that it accepted 549 nomination applications, which were complete in terms of conditions required in applications by law. It also rejected 32 lists due to age, incomplete women quota, resignation certificates of governmental employees are not attached, registered in another constituency or the list includes a candidate not registered in the electoral register while other four lists have withdrawn. It is worth noting that the HDIP observers documented the withdrawal of the Palestinian National Initiative list, which should have won by default when the other parties and independents could not form another list in Fahma local council. But the security apparatuses put pressure on the list of the Palestinian National Initiative to withdraw. As a result the Palestinian National Initiative submitted a complaint 11

specific list. Chapter Seven of the Law sets forth certain controls to be abided by the elections lists in their elections campaigns. The Law has also given the election list the right to announce their elections platforms and to actively communicate with the voters, in a manner not contradicting with the Law. The Law also identified criteria and foundations on which the election campaigns within the framework of neutrality and equality. The election campaign means the various activities and events conducted by the elections lists and candidates to explain their election programs and platforms to the voters’ public and the calls they make to vote for their interests. Article 25 of the Local Councils Elections Law No.12 of 2005 states that“electoral list or their candidates may organize various events to explain their elections programs to the public, in the style or method they deem appropriate, without prejudice to the valid laws and regulations.” In the last local elections, the Central elections Commission designated the elections campaign in a period of 13 days, which started on Saturday morning 6 October 2012 and ended on Thursday evening 18 October 2012. The Commission banned any election campaigns activities before or after these dates. Article 28 of the above-mentioned Law bans holding festivals or public meetings at mosques or churches, near hospitals, building or places occupied by governmental departments or institutions, Palestinian security headquarters or in the vicinity of the elections centers. 10

citizens who have fulfilled the legal conditions of candidacy. The candidate in an elections list prepared by political parties or independent individuals shall fulfill the candidacy conditions set forth by Local Councils Elections Law No.12 of 2005. Article 2 of this Law states that a candidate in a list shall attain 25 years on the ballot day, his /her name enlisted in the final voters’ lists of the constituency of his/her candidacy, fulfill the voter’s requirements, not to be indicted by a felony against honor or a crime, not to be an employee at the Ministry of Local Government, any public security apparatus or a lawyer to them, unless he had resigned and attaches a resignation certificate to the nomination application, to be a resident within the local community he/she is running for a period of no less than one year from the date of conducting the elections and not to be a candidate in another constituency or another list. Article 1 of the same Law stipulates that women representation in any electoral list for the local councils shall not be less than 20% on condition that each list shall include a minimum women representation. Elections Campaigns The process for calling voters to elect the lists starts within the elections campaign, which is the legal period prior to the voting day. In this process the electoral lists are given the freedom to get acquainted with their voters and to announce their principles and platforms. According to Article 27 of the Local Councils Elections Law No.12 of 2005, the elections campaign shall commence two weeks before the designated polling day and shall end twenty four hours prior to the polling day. During this period, legal competition among lists take place in order to influence the public opinion to elect a 9

Voters Registration Process The registration process means that the individual voluntarily and freely asks to register his/her name in the electoral register to have the right to participate in the electoral process. This is due to the fact that no individual can vote without having his/her name in the electoral register prepared by the Central Elections Commission. Article 8 of the Local Councils Elections Law No.10 of 2005 states that“Anyone who fulfils voter’s conditions shall have the right to enlist his/her name in the voters’ list of the constituency where he/ she resides.” An individual does not have the right to register in more than one constituency. The Law also allows the individual to register in any area he/she is willing to vote in. Article 9 of the same Law stated that the Central Elections Commission shall prepare the final voters’ list prior to a period not less than 60 days and not more than 90 days. According to the Law, every person shall have the right, within the objection period, to object if his/her name is not included in the electoral register or if any other person is registered in a constituency without having the right to register in it. The five-day objection period takes place after completing the registration process and during the process of disseminating the register. The registration process of voters is considered one of the most important guarantees that achieve equality among individuals in practicing their political rights. Electoral Lists The registration process of the elections lists is one of the basic phases for the elections process. It also has a great importance in achieving impartial elections. The validity and integrity of the elections system is dependent on the extent to which the official elections lists are credible and accurate and which include names of 8

In accordance with this system, nomination will be conducted in electoral lists that do not include the names of their candidates on the ballot papers. Names of candidates on the lists are ranked by the priority of each candidate, provided that the number of the lists candidates does not exceed the number of seats allocated for the local council. A number of the council’s seats shall be allocated for each list that gets 8%(threshold percentage) or more of the valid votes of voters proportional to the number of valid votes it obtained. The seats that each list gets shall be distributed on its candidates according to the serial order of their names in the list and according to Saint Logi Method for election count of votes. Each local council district is considered one constituency and for each local council a number of seats is allocated in proportion with the number of population of the locality to which the local council belongs. Theoretical Framework The electoral process is based on a number of procedures having close relevance with the balloting process. To achieve impartial and fair elections, these procedures have been regulated in a legislative framework to be committed to by all elements of the electoral process starting with the Palestinian government to the political parties and electoral lists and passing through the Central Elections Commission. The electoral process undergoes different phases to reach the voting process. These phases have been organized in special legislations for each phase under the Local Councils Elections Law No. 10 of 2005. 7

Local Councils Elections Law No. 5 of 1996 This law, which adopted the majority system, was issued on 16 December 1996. In this system, candidates compete as individuals and candidates and those who have the highest number of votes win the elections. Rounds one and two were conducted according to this Law. Local Councils Elections Law No. 10 of 2005 On 13 August 2008, the Palestinian Legislative Council endorsed the Local Councils Elections Law No. 10 of 2005 which was issued by President Mahmoud Abbas on 15 august 2005. This Law superseded Local Councils Elections Law No. 5 of 1996 and amended some provisions of the Local Councils Elections Law No. 5 of 2004. Moreover, it changed the electoral system from majority system(constituencies) to proportional representation system(lists) in addition to including a quota for women in the local councils’ seats. Some provisions of this Law have also undergone certain amendments under the Local Councils Elections Law No. 12 of 2005 by amending some provisions of the Local Councils Elections Law No. 10 of 2005, which was approved by the Legislative Council on 27 August 2005 and issued by President Abbas on 29 August 2005. Phases three and four of the local elections were held according to this amended Law. On 8 February 2010, the Palestinian Ministers Council issued a decision calling for holding the second local councils elections throughout the West Bank and Gaza Strip scheduled on Saturday 17 July 2010 on basis of the Local Councils Elections Law No. 10 of 2005 and its amendments and according to the proportional representation system(lists) adopted by this Law. But the elections have been cancelled by a decision issued by the Ministers Council. 6

training courses aiming at providing observers with skills needed in the election observation process. Within the preparations framework of the HDIP observation role on local elections 2012, HDIP trained 36 observers(males and females) distributed on seven governorates throughout the West Bank in addition to five observers from its employees. These five employees were trained to oversee the observers work. In the same context, a special questionnaire has been prepared for observing the elections. The questionnaire was distributed on the observers. The questionnaire included details on the balloting and counting process to be observed and how to register remarks on that regard. Using the questionnaire ensures that observers will have similar directions in their work. It will also provide an adequate database on issues that HDIP is concerned to observe regarding the elections process and to verify the compliance of the elections process with Law No. 10 of 2005 Concerning the Local Councils Elections. Legal Framework The first local elections in the West Bank and Gaza Strip have taken place on four rounds while the fifth round has not taken place: Round one: Held on 23 December 2004 Round two: Held on 5 May 2005 Round three: Held on 29 September 2005 Round four: Held on 15 December 2005 5

the violations registered is that the manifestations of the electoral campaigns continued on the ballot day, particularly by supporters of the Independence and Development lists. In contradiction with the Elections Law, the supporters of these lists put their lists’ posters on the entrances of the ballot centers and distributed publications calling voters to vote for their lists. Other observers reported cases in which a number of ballot committees’ members spoke with the voters encouraging them to vote for specific lists, which is also in contradiction with the law. This final report is an evaluation summary of the role played by HDIP in observing all phases of the elections process, including the nomination process, electoral campaigns, voting and counting of votes, and announcement of the official results. The report started with the role of HDIP in observing the elections followed by its role during the nomination and electoral campaigns periods. Then it moves to present the role played by the HDIP members on the ballot day including opening the voting boxes and progress of the voting process. The report continues to cover the end of voting hours and closing of the voting centers and stations and counting of the votes in the stations and centers until the end of this process. The report concluded with certain remarks and recommendations on the balloting and counting process organized by the Central Elections Commission. Observation Role of HDIP HDIP has a distinguished experience in observing the local and general elections. It played a vital role in observing the presidential elections with all its phases in 2005 and the legislative elections in 2006. Through this role, HDIP was able to establish a trained observation team capable to carry out a full observation process on any type of elections. Moreover, the team is qualified to hold 4

councils, which included 911 ballot stations and 2647 candidates (males and females) in 317 electoral lists competed on 1051 seats. In 180 local councils, the elections have not been held because only one list nominated for the council’s membership and hence the list won by default. In another 70 locations, the elections have not been held because there were no candidates and thus no lists were nominated and accordingly, another round of elections has been scheduled for these locations on 24 November 2012. According to the initial assessment issued by the Health, Development, Information and Policy Institute(HDIP) on the eve of the ballot day on basis of the initial survey of reports and questionnaires prepared by its observers, HDIP expressed its dissatisfaction of certain unjustified and irresponsible infringements and violations done by certain electoral lists, some security apparatuses members, and the employees of the Central Elections Commission in the ballot centers. However, in general the elections process has taken place peacefully and in an organized manner. The overall elections environment has been transparent; especially by the Central Elections Commission and the elections have taken place in the presence of the candidates and the electoral lists agents. The report commended the full cooperation of the Central Elections Commission in facilitating the adoption of local observation bodies, issuing identification cards for the observers and enabling them to observe the voting and counting process. HDIP has participated in the process through its observers who have been present in all locations throughout the West Bank. The initial report also pointed out that the HDIP observers recorded many violations committed by the competing parties or candidates. Nevertheless, the voting and counting process has taken place safely, peacefully and without any substantial problems that might affect the impartiality of elections and their results. Introduction The Palestinian local elections have been held in the West Bank while in Gaza Strip Hamas boycott and prevented the elections from taking place as it did not allow the Central Elections Commission from registering the voters. The local elections that were held are the first after repeated delays since the last elections in 2005, which resulted in the division of the Palestinian society between the West Bank and Gaza Strip. This situation created a state of emptiness in many village and municipal councils. The local elections were supposed to be held in 2010. But after setting a date for the elections, it was cancelled. Consequently, Palestinian factions and civil society organizations took the case to the Supreme Justice Court in objection to the elections cancellation. The Court ruled that cancellation of the elections is illegal and not within the jurisdiction of the government. As a result, the Palestinian government set another date for the elections and again cancelled it. This created a state of mistrust and incredibility in the government among voters who accused the government of being not serious in holding the local elections, which indeed affected the voters’ participation turnout, which has not exceeded 54% of those who are eligible to vote. On 20 October 2012, Palestinian voters in the West Bank casted their votes to choose their representatives in 93 local councils.
