Abstract
Simple practices of ensuring workplace efficiency, monitoring and surveillance have advanced leaps and bounds due to technology advances. The Covid-19 pandemic has also legitimised new forms of health-related data collection. Workers remain disadvantaged by the relative ease with which employers can combine data from several sources. The monitoring by employers can further contribute to shifting the power dynamics between employees and employers as the imbalance of access to worker data can reduce their negotiating power. The paper compares some best practices from other existing data protection laws and makes suggestions that could be considered for India's data protection bill and labour reforms to protect workers and their data.
