The essence of democratic elections is that they be free and fair. Electoral frauds and malpractices has become more or less a feature of Nigeria�s elections because of the �do or die� attitude of some Nigerians politicians and political parties. People commit electoral offences with impunity because they believe they can get away with it. Unfortunately INEC does not have the capacity to prosecute electoral offenders which leads to the recommendation by the author for an establishment of an Electoral Offences Commission and Tribunal to reduce electoral malpractices and offences in the country.
